Provider and Scope HundBunt is provided by Aidar Sadykov, trading under the business name Aidar Sadykov Paw Solutions. Further information about the provider and contact details is available in the Legal Notice. These Terms of Use apply to the use of HundBunt by registered users. Only adults with full legal capacity may register. Anyone acting on behalf of a company must be authorised to do so. 2. Purpose and Role of HundBunt HundBunt is an online listings, search and contact service for pet care services. In particular, users can create profiles, search for pet sitters and communicate with one another. HundBunt does not provide any booking, contract confirmation, payment or transaction processing function specifically intended for pet care services. In particular, HundBunt neither records nor confirms whether users have entered into a pet care contract, what remuneration has been agreed, whether pet care has taken place or whether a payment has been made. The chat is intended for communication between users. Whether statements made there have legal effect in an individual case depends on the statements made by the users involved and the applicable statutory provisions. 3. Agreements Between Users Pet sitters operate independently and may act as private individuals or as businesses. In relation to their pet care services, they are neither employees, representatives, agents nor vicarious agents of HundBunt. Any contract for pet care exists exclusively between the users involved. HundBunt does not become a party to the contract and, in particular, does not determine the price, performance, cancellation or any other terms of the pet care arrangement. Users are responsible for assessing the other party and their suitability for the desired pet care, and for making all necessary arrangements. This includes, in particular, exchanging safety-related information about the pet, such as information concerning behaviour, health, medication or special care requirements. Pet sitters are responsible for complying with all statutory, regulatory, tax, trade and insurance requirements applicable to their activities. 4. User Accounts and Content Users must provide accurate and current information and protect their login credentials appropriately. HundBunt must not be used for unlawful acts, deception, fraud, spam, harassment, threats or any other misuse. In particular, content must not be knowingly false or misleading or infringe the rights of third parties. Users may only provide content which they are entitled to use. Users retain the rights to their own content. For the duration and purpose of using HundBunt, the user grants HundBunt the necessary non-exclusive right to store and technically process this content and to display it in accordance with the visibility settings selected by the user. 5. Review of Pet Sitter Profiles When activating a pet sitter profile, HundBunt assesses only the information and documents submitted during the application and profile process. HundBunt does not conduct independent background research into a pet sitter's personal or professional history and, in particular, cannot determine whether there are undisclosed previous activities, incidents or other circumstances. HundBunt has no general access to public authority registers or comparable information not provided by the pet sitter. Activation of a profile therefore does not constitute licensing, certification, a recommendation or a guarantee of a pet sitter's personal or professional suitability, reliability or safety. Where HundBunt expressly states that a specific item of information has been checked or verified, this relates exclusively to the stated subject of that check and to the information or evidence submitted for that purpose. Users must decide for themselves whether a pet sitter is suitable for the desired pet care. 6. Reports, Moderation and Suspension Illegal content and breaches of these Terms of Use may be reported electronically by email to info@hundbunt.de or through the support form at https://hundbunt.de/support. HundBunt may remove content or restrict its visibility and may restrict accounts or functions where there are specific indications of legal violations, fraud, misuse, significant security risks or breaches of these Terms of Use. Technical tools may be used to detect and address spam, misuse or security risks. Reports and necessary case-by-case decisions may additionally be reviewed by people. Where required by law, affected users will be informed of the reasons for a measure and of any available review options. 7. Search and Visibility Search results are determined in particular by the search and filter criteria selected by the user and by the sorting option offered in each case. There is no entitlement to any particular ranking, visibility or number of contact requests. Where additional ranking parameters are used, their main criteria and significance will be explained transparently. If paid features affect the visibility or ordering of profiles in the future, this influence will be clearly and transparently identified. 8. Availability and Termination HundBunt does not guarantee uninterrupted or error-free availability at all times. Maintenance, technical faults and security measures may, in particular, result in restrictions. Users may generally close their account at any time using the function provided for this purpose. HundBunt may terminate free-of-charge user relationships by giving reasonable notice. In the event of serious legal violations, misuse, risks or other compelling reasons, content, functions or accounts may also be restricted or suspended without prior notice. Commercial pet sitters are additionally subject to the Special Terms for Pet Sitters and mandatory statutory provisions. 9. Liability HundBunt is not responsible for the acts or omissions of other users or for the conclusion, content or performance of agreements between users. This applies in particular to pet care services, payments and damage caused by users or pets in their care, unless HundBunt itself has breached a duty. HundBunt has unlimited liability for intent and gross negligence, for damage arising from injury to life, limb or health, and in any other cases of mandatory statutory liability. In the event of a slightly negligent breach of an essential contractual obligation, liability is limited to the foreseeable damage typical of the contract. Liability for slight negligence is otherwise excluded. 10. Amendments and Final Provisions HundBunt may amend these Terms of Use for an objective reason, in particular due to legal, technical or functional changes. Users will be informed of material changes before they take effect. Where express consent is required, an amendment will not take effect solely as a result of silence. Commercial pet sitters are additionally subject to special statutory and contractual rules governing amendments. German law applies. Mandatory consumer protection provisions of the country in which a consumer habitually resides remain unaffected. No exclusive place of jurisdiction is agreed in relation to consumers.
